TOPEKA If Anderson
County wheat growers and
others in Eastern Kansas
used fungicides and didnt
put a big investment into
lower contracted prices for
their crop, 2022s record
wheat prices may make for
a banner year after cutting
starts here in coming days.
While those prospects
are better on our side of the
state, the news has not been
so good for farmers in the
drought-stricken western
and southern reaches of
Kansas.
Its hard to get excited about this, said Tyler
Ediger, who farms with his
family and raises seed wheat
in Meade County, told the
Kansas Wheat Commission
as the harvest in Kansas
reached Day 4 last week.
Extreme drought in the
area throughout the growing season is severely limiting yields, causing more
abandonment and calls to
the insurance adjuster in
the region. Even fields that
look somewhat decent from
the road and are disappointing in the bin, adding to the
stress from difficulties finding help and escalating fuel
and input prices.
But in Anderson County
and the surrounding area,
near weekly rains through
April and May bolstered a
crop that now, by most measures, looks pretty solid at
just the right time.

Extension Agent Ryan
Schaub told the Review last
week that though he was
unaware of any wheat cutting or test cutting so far,
he expected at least average
yields if growers had protected themselves against
the problems lots of rain can
bring.
I would expect our yields
to be around average for our
area if the producers put any
fungicides on and had adequate fertility, Schaub said.
With the rain we received
in May, if we didnt get a fungicide on I think those yields
could really suffer.
Typical yields in this area
run around 40 bushels per
acre. Last year, Anderson
County farmers harvested a
comparitively small 11,000
acres of wheat for about
438,000 bushel, which averaged a little over 39 bushel
per acre. This year, weather in the west and south
has been a particular issue,
while rainfall locally has
been abundant.
Kansas Senator Roger
Marshall estimated the state
would lose 30 percent of its
wheat crop some 100 million bushel due to drought
during his testimony before
the Senate Agriculture
Committee earlier this
month.
The advantage will go
to whoever has wheat this
year, and more so to those
who gambled to go without a contracted sale price.
Prices for wheat in 2020 were
just over $5 per bushel. The
USDA projects prices to hit
$10.75 this year and some say
it could break $11.

announced the resignation of
Elmore Patterson last week.

CEO of the Critical Access
Region for the Kansas City-
based hospital network,
would serve
as interim
administrator of both
locations
while

on city rec department
Sheahan says problems

GARNETT A Garnett City
Commissioner has cancelled a plan
to propose the adoption of a resolution of no confidence in the citys
parks and recreation department
and its director Phil Bures at next
weeks city commission meeting, in
what was planned as a not-so subtle
effort to direct a change of management in that department.
Commissioner Jason Sheahan
posted a draft of the resolution on
his commission Facebook Page
last week, which details the city
commissions position and limits
in direct management of city staff
other than the city manager. The
resolution relays that city staff
and commissioners have received
numerous complaints about the
parks and recreation department,
and that repeated attempts to rectify those problems have failed.

the lack of confidence they have in

IOLA A Republican candidate for
Kansas governor from Kincaid was
arrested Wednesday on charges of
threatening two Anderson County
law officers, apparently in connection with a law enforcement investigation in process against another
southern Anderson County man.
Arlyn Briggs, 64 of Kincaid,
was arrested June 15 in Iola on
an Anderson County warrant alleg-
ing criminal threat and associated offenses. He bonded out of jail
the same day on a
$75,000 cash surety bond.
Briggs maintains
while his rhetoric was firey, he
meant no harm in
defending a family friend involved
in his own legal

Health is focus of new fitness court
GARNETT Blue Cross and Blue Shield
of Kansas (BCBSKS) and the National
Fitness Campaign (NFC) are pleased
to announce the launch of an outdoor
BCBSKS Fitness Court at The Santa Fe
Depot in Garnett.
The Fitness Court was officially
unveiled at a ribbon cutting ceremony
at 5 p.m.., Thursday, June 9. This launch
is a result of the statewide partnership
between BCBSKS and NFC to expand
free access to high quality workouts and
create equitable access to exercise in
communities around the state of Kansas.
The new BCBSKS Fitness Court at The
Santa Fe Depot is an open-air wellness
center that allows users to leverage their
own body weight to get a complete workout. Created with adults of all ages and
abilities in mind, the Fitness Court is
adaptable for all fitness levels. New users
can also download the free Fitness Court
App a coach-in-your-pocket style
platform that transforms the outdoor
gym into a digitally supported wellness
ecosystem. The Fitness Court App is
available for iOS and Android.
Garnett is the second outdoor Fitness
Court in a series of 10 BCBSKS Fitness
Courts that will be constructed in easily
accessible public spaces through 2022.

Tom Young, Planning & Zoning
Director, met with the commission.
He presented his 2023 budget.
Anderson County EMS
Troy Armstrong, EMS Director, and
Stephanie Smith, ACH Accountant
II, met with the commission. Troy
gave an overview of the EMS annual
report and what calls/runs the EMS
department went on. He also talked
about their vehicle rotation schedule and costs that the department
incur. Stephanie Smith presented the
2023 budget request for the ambulance service and for the Board of
Trustees. St. Lukes is requesting a
$611,715 subsidy for the ambulance
service and $40,000 for the Board of
Trustees making their total subsidy
from the county $651,751.
Emergency Management
JD
Mersman,
Emergency
Management Director, met with the
commission. Discussion was held
on the 800-radio project and how the
county will not be able to afford it at
this time. The current system that is
in place could use some upgrading
and possibly another tower site for
added coverage in the county.

other improvements that are being
considered for the school facilities.

Accident Reports
On June 4, 2022, at 3:44 p.m. a
vehicle driven by Sydney Amaya, 28
of Garnett, rear-ended a southbound
vehicle driven by Joe Johnson, 38 of
Olathe, at alocation north of Garnett
Elementary Center on U.S. Highway
59 after Johnson braked to avoid a
deer. Amaya had minor injuries but
declined EMS transport. Amya was
issued a summons for basic speed
rule too fast for conditinos.
On April 11, 2022, 7:25 a.m.,

2000 about one-half mile east of

On October 3, 1952, she married Raymond (Ray) Gooding.
She was a nurses aide
at both Anderson County
Hospital and Ransom Memorial
Hospital. She also worked as a
waitress, and along with husband Ray ran the 50-59 Grill in
Ottawa and Lucilles Cafe in
Williamsburg.
She is survived by her
daughters, Cynthia (Cindy)

Williamsburg, and sons Bill
Gooding of Williamsburg

a WILDCAT. He was a past
member of the FOE Topeka
Aerie #58. He graduated from
Hayden High School in 1950.
He is survived by nieces and
nephews, and longtime roommate, Colin Hall of Topeka,
Kansas.
One sister and four brothers
preceded him in death.
The family will receive
friends on Friday, June 24,
2022, at 9:00 A.M. with a Mass
of Christian Burial to follow
at 10:00 A.M. at Christ the
King Church. Burial will be in

She worked at various
restaurants and became a
C.N.A. for over 20 years.
Shirley loved flowers, with
tulips being her favorites. She
enjoyed gardening, canning,
and cooking. One of her great-
est joys was cooking and preparing feasts for her family.
She also enjoyed her dogs and
her cats and taking day trips
traveling to unplanned destinations.
She was preceded in death
by her parents, Walter and
Clara Hartman; one brother,
John Hartman; and one sister-in-law, Ruth Hartman; one
step-son, Jerry Hunt.

Tyson for Kansas State Treasurer
The duties of the Kansas State Treasurers
office call specifically for someone like Kansas
Senator Caryn Tyson, and her time in Kansas
public office proves shes particularly suited for
that post. Her opponents in both the Republican
primary and the general election this fall well,
not so much.
In other industries they refer to such proficiencies as core competencies the idea that an
individual or an organization possesses not just
one or a few of the qualities that lend toward
accomplishing a task, but that the summation
of myriad points predicts a high probability of
success. Her degrees in computer science and
math and an advanced degree in engineering
management alone dont foretell the job shell do as state
treasurer until we consider
her education in the context
that shes the only candidate
in the race thats ever actually saved you money.
State Treasurer is an
office like others in state government like Secretary of
Tyson
State and Commissioner of
Insurance that doesnt draw
the spotlight unless something goes wrong.
Most people really have no clue what Kansas
official chief financial officer does or what
responsibilities go along with the office.
The state treasurer is tasked with managing
the public funds of the state all the money
collected by Kansas from property taxes to
investment interest to sales taxes to fishing
licenses and managing that cash to ensure it
comes from where its supposed to and gets to
where its supposed to go to your city, your
school district, payrolls for highway workers
and state employee retirement funds. Its a
multi-faceted organization that also includes
its own administrative division, a municipal
bond services division that approves, monitors
and pays any bonded indebtedness in the state,
as well as an unclaimed property division that
aims to find owners for abandoned assets left
idle by businesses and individuals.
Similarly as interesting is the fact that the
Kansas State Treasurers office is a fee-funded
agency, meaning its paid for by user fees for
services statewide and not by taxes.
Tysons work in the Kansas Legislature has
never been high profile, but instead always
focused on the meat and potatoes of conservative state management and traditional Kansas
values. Shes been a solid pro-life vote and
a stalwart Second Amendment and personal

protection supporter. She broke from other
Republicans in 2015 and 2017 to oppose tax
increases that still drain Kansans wallets to
this day, and months ago she passed legislation
that exempted the first $100,000 of residential
property value from the states 20-mill school
finance plan.
The other Republican in the race,
Representative Steven Johnson of Assaria,
voted against a provision that defined concealed carry in Kansas; supported Kansas taxpayers funding illegal immigrants with in-state
college tuition and supported taxpayer funds
for abortion in the state. By voting for the 2015
and 2017 tax increases, Johnson chose the path
too often selected by Democrats toward seeking
the easy fix taking more of your money as
opposed to making hard leadership decisions to
reduce spending.
Lynn Rogers, the sole Democrat and the
incumbent treasurer in the race, has been as
much a stealth state treasurer with his appointment since Jake LaTuner left the office to
become 2nd District U.S. Congressman as he
was as lieutenant governor (yes, he was lieutenant governor under Laura Kelly). Rural
Kansas is still waiting for the rural initiative
package Rogers and Kelly trumpeted when he
made his grand fact-finding tour of small towns
in the state in 2019. We got what we expected
nothing.
Knowing Rogers was Kellys selection, and
knowing the degree to which the governor
embraces Joe Bidens affinity for economic and
cultural disaster as its currently playing out
on the national stage, its clear Rogers is not a
choice for Kansas.
We want better than that for Kansas State
Treasurer, and well get it with Caryn Tyson. ###

They are bad here in southern Anderson County

The federal government continues to pay
farmers not to farm on some 22 million acres
of farmlands that are a part of the voluntary
Conservation Reserve Program, established in
1985 to address soil erosion and other environmental impacts caused by farming, even as the
global supply crisis, the war in Ukraine and
bad weather are all combining to reduce global agriculture production in 2022, threatening
starvation in the third world.
In any given year, before the Covid supply crisis or the war in Ukraine, 9 million
people were already starving to death each
year, according to global health estimates
by the United Nations and the World Food
Programme.
Now, that crisis could get even worse, as
global wheat production is taking a major hit,
according to the latest data by the Department
of Agriculture in May: Global production
is forecast at 774.8 million tons, 4.5 million
lower than in 2021/22. Reduced production
in Ukraine, Australia, and Morocco is only
partly offset by increases in Canada, Russia,
and the United States. Production in Ukraine
is forecast at 21.5 million tons in 2022/23, 11.5
million lower than 2021/22 due to the ongoing
war.
Recently, wheat has been particularly
hard hit, with U.S. wheat production down

15 percent since 2019, from 1.93 billion bushels in 2019 to 1.64 billion in 2021, according
to data compiled by the U.S. Department of
Agriculture.
According to a March Department of
Agriculture release on prospective plantings,
2022 will be the fifth lowest area planted since
1919: All wheat planted area for 2022 is estimated at 47.4 million acres, up 1 percent from
2021. If realized, this represents the fifth lowest all wheat planted area since records began
in 1919.
Just on June 7, Peter Sands, the executive
director of the Global Fund to Fight AIDS,
Tuberculosis and Malaria, told Reuters that
the current global food crisis could kill just
as many people as Covid. To date, almost 7
million people have died globally from Covid.
Sands warned: Food shortages work in
two ways. One is you have the tragedy of people actually starving to death. But second is
you have the fact that often much larger numbers of people are poorly nourished, and that
makes them more vulnerable to existing diseases Its not as well-defined as some brand
new pathogen appearing with distinctive new
symptoms. But it could well be just as deadly.
Meaning, millions more could starve
more than usual if global agriculture production does not soon catch up to demand.
So, what are we doing about it? On May 11,
President Joe Biden told the nation that U.S.
farmers were expanding production and feeding the world in need this year. But so far,
Biden only pointed to a federal insurance program to incentivize farmers in the short term
to engage in double cropping, whereby fields
are planted twice in a season and harvested
early.
That might help. But what about the 22
million acres that the federal government is
sitting on as a part of the U.S. Department of
Agricultures Conservation Reserve Program?

Biden 2024 analysis reveals the Kamala problem
The media taboo against talking about Joe
Bidens age and the obstacle it presents to his
running again in 2024 is finally off.
Which should put a lantern on another
looming problem for the Democrats — waiting
in the wings is a deeply unpopular officeholder, who makes Biden look like a prospective
electoral juggernaut by comparison.
Democrats can be forgiven for considering
the possibility of only Kamala Harris standing
between them and a return of Donald Trump
and telling themselves, Well, maybe 80 is the
new 75, or, Bidens always been gaffe-prone,
so whats a few more gaffes between friends?
or, Biden campaigned from a basement in
2020 — surely, he can campaign from some
similarly secluded and safe space in 2024.
Harris is the single best argument for
Democrats trying to prop up Biden no matter
what. She has been a disaster as vice president, even as shes done nothing particularly
noteworthy either good or bad. Shes simply
a political black hole, whose abysmal ratings
reflect not just Bidens troubles but her own
profound, inherent flaws as a political figure.
Kamala Harris has the authenticity of Hillary
Clinton, the charm of Al Gore, and the common touch of Adlai Stevenson.
She could have been engineered in a lab
as a conviction-less opportunist lacking basic
political horse sense — and she more or less
was. She came up in a California where the
dominance of TV ads makes retail politicking
all but unnecessary, and internal Democratic
politics is largely based on identity politics.
Compared to her, Biden really is Middle Class
Joe. The contrast with Chuck Schumer, another Democratic leader from a deep blue state, is

instructive — Schumer had a tough statewide
race against a Republican within memory
and is aware that not all voters are extremely

Harris could have run as an ideologically
interesting, tough-minded former prosecutor

mayoral primaries last year. Instead, she got
sucked into the idea that the winning lane
would be a couple of ticks to the right of Bernie
Sanders. She co-sponsored his Medicare for
All proposal, before making a confusing hash
of her position when she realized the political
implausibility of the plan.
She seemed defensive about her record as
a prosecutor, which came under withering
assault from Rep. Tulsi Gabbard from the left.
Her signature moment — attacking Joe Biden
for his opposition to busing based on her own
experience getting bused — didnt pay the
expected dividends because of its self-evident
calculation.
Harris is a politician who always seems
to be reading stage directions out loud. Her
laugh, a target of critics, usually sounds forced
and highly deliberate, at times bordering on
inappropriate affect. Its a valuable political
skill to seem at ease even when reaching for
the brass ring at the highest level of American
politics. Bill Clinton, George W. Bush and
Barack Obama all had this ability. Harris has
shown no indication that she has it or will
develop it.
Biden has done her no favors with her
assignments as vice president. Given the foolhardiness of the underlying Biden policies,
there was no realistic way she was going to
diminish migration at the Southern border.
Nor was she going to do anything to get a voting rights bill passed. That said, Harris hasnt
mastered any particular issue area and gives
the impression of seeking tableaus that will
lend to her gravitas without ever succeeding.
On top of all this, she hasnt managed to
secure a close, trusted relationship with the
president.
Any rational observer could have predicted
that Bidens VP pick was going to be particularly sensitive given that, as de Gaulle famously said, Old age is a shipwreck. Instead,
Biden played identity politics by choosing
Harris, and its understandable now that some
Democrats would like, against all evidence, to
bank everything on Bidens youthful vigor.

Why arent we tapping that as is already allowed
under federal law?
Specifically, 16. U.S.C. section 3833(b)(1)(B)
(i)(I)(cc) allows the Secretary of Agriculture to
allow for farming on lands in the Conservation
Reserve Program when there is a drought or
another type of emergency: The Secretary
shall permit certain activities or commercial
uses of established cover on land that is subject
to a contract under the conservation reserve
program if the Secretary includes contract
modifications without any reduction in the
rental rate for emergency haying, emergency
grazing, or other emergency use of the forage
in response to a localized or regional drought,
flooding, wildfire, or other emergency, on all
practices, outside the primary nesting season,
when the Secretary determines that the
program can assist in the response to a natural
disaster event without permanent damage to the
established cover
We have all of the above. Theres a drought in
the southwest United States presently. Theres
too much rainfall in North Dakota. Theres also
the overall global supply crisis and the war in
Ukraine.
Overall U.S. agriculture production has been
down, with planted acres recently peaking at
319.3 million acres in 2018, according to data
compiled by USDA. In 2019, amid flooding, it was
down to 303 million acres planted, 310 million
acres planted in 2020 during Covid and 317 mil-

And that is far below the level of farming that
used to take place here. Acres planted actually
peaked in 1932 at 375 million acres planted. That
was right before the Dust Bowl of 1934, which
drove planting down to 339 million acres planted
before recovering to 361 million acres planted in
1935.
Then, with the advent of suburbs, agriculture
production took further hits in the 1960s, when
annual land planted was down to less than 300
million acres. It experienced a resurgence in the
1970s and then peaked again at 361 million acres
planted in 1981.
Those numbers took a big hit, though, after
the 1985 Conservation Reserve Program was
established. In 1985, before the program took
effect, 353 million acres were planted. In 1986,
that number immediately dropped to 338 million
acres planted. And in 1987, it was down to 315
million acres planted.
If there ever was a valid basis for President
Biden and the USDA to take exception to the
Conservation Reserve Program, this is it. These
farmlands should be planted before it is too late.
My worry is that we will look back on this situation in a year or so and ask, Why didnt we plant
more?

Tour of Shelbyville, then headed home
Our wonderful and exciting
trip to Kentucky comes to an
end. After our lunch at Claudia
Sanders in Shelbyville our next
thing on our agenda was a tour
of Louisville, Kentucky. We
crossed into Indiana at 1:30pm.
At 2:35 every phone on the bus
went off with a tornado warning. Soon we were driving in
blinding rain, small hail and
terrific winds. There was no
where along the highway to
pull off as cars and trucks were
parked everywhere. Radar on
the bus showed the actual tornado behind us. Our bus driver
kept creeping along.
It wasn't long until phones
went off again, this time the
radar showed a possible tornado ahead of us. The Lord was
certainly watching over us as
this storm passed directly over
us. Boy,were we ever ready for
a rest stop and that's exactly
what we did, at a Pilot Rest
Stop. Here we also returned to
DIGGING UP THE PAST

the Wabash River in Illinois,
headed for the Missouri line.
At 5:55 we arrived at the Drury
Inn in St.Peters, Missouri for
our nights stay.
Shortly after arriving we all
enjoyed their Kick-Back dinner.
Friday 20 May 2022
Up early. Everyone anxious to
get back home. We were on the
road at 7:30 headed for Kansas.
Today was declared Peanut
& Coke Day, so we took our
morning break at Booneville,
Missouri, everyone was buying
little bags of peanuts and cans
of Coke. Quite an ordeal. After
our break our hostess Angie
played a video of Leonard
Yoder and his family making
kettle corn. Very interesting.
It was soon 11:55 and time
for a lunch break. We had what
was called a "Scatter Lunch"
Otherwise we had about four
places we could go to for lunch.
Kay and I chose the Chinese
Buffet. Very good. This stop
was in Olathe Ks., so Kay & I
were only about one hour from
our final stop. In fact it only
took us 45 minutes to arrive in
Ottawa. It was hard to tell all
our new friends, hostess & bus
driver goodbye.
This was one trip Kay & I will
never forget. So many wonderful memories.

us that many people came to
believe in Jesus, but didn't

others became disciples,
but didn't make disciples of
others. Matthew 28 tells us
that Jesus calls us to go out
and teach others and make
disciples of all the nations.
To do this, we
must study God's
word and gain a
mature understanding of it, and
then search out
others to teach.
At VBS, the children were taught: God loves
you no matter what, God is
with you everywhere, God
is in charge, God is stronger
than anything, and God is surprising. God loves you no matter what mistakes you make,
or how big you fail. He has a
plan for you and will always
be right there to help you. Not
even the powers of Hell can
separate us from God's love,

(Published in the Anderson County Review on
June 21, 2022)
ORDINANCE NO. 4238
AN ORDINANCE OF THE GOVERNING
BODY OF THE CITY OF GARNETT, KANSAS
ESTABLISHING A REDEVELOPMENT
DISTRICT WITHIN THE CITY AND MAKING
CERTAIN FINDINGS IN CONJUNCTION
THEREWITH (GUFFEY PROPERTIES, LLC
REDEVELOPMENT DISTRICT).
WHEREAS, the City Commission (the
Governing Body) of the City of Garnett,
Kansas (the City) desires to promote, stimulate and develop the general and economic
welfare of the City and the state of Kansas (the
State) and to assist in the development and
redevelopment of eligible areas within the City,
thereby promoting the general welfare of the
citizens of the State and the City, by acquiring
property and providing for the development
and redevelopment thereof and the financing
relating thereto; and
WHEREAS, pursuant to the provisions of
K.S.A. 121770, et seq., as amended (the Act),
the City is authorized to establish redevelopment districts within eligible areas of the City,
as said terms are defined in the Act, to approve
redevelopment district plans for the completion
of redevelopment projects within such redevelopment project areas, and to finance all or a
portion of redevelopment project costs from tax
increment revenues and various fees collected
within such redevelopment district, revenues
derived from redevelopment projects, revenues
derived from local sales taxes, other revenues
described in the Act, or a combination thereof
or from the proceeds of full faith and credit tax
increment bonds of the City or special obligation tax increment bonds of the City payable
from such described revenues; and
WHEREAS, an eligible area, as defined
in the Act, includes a conservation area, as
defined in the Act; and
WHEREAS, a conservation area as
defined in the Act, includes an area in which
a 50% or more of the structures have an age
of 35 years or more and may become blighted
due to due to the dilapidation and deterioration
of the structures and the presence of structures
below minimum code standards; and
WHEREAS, prior to the creation of any
redevelopment district, the Governing Body
must adopt a resolution stating that the City
is considering the establishing of a redevelopment district, which resolution shall: (1) Give
notice that a public hearing will be held to
consider the establishment of a redevelopment
district and fix the date, hour and place of such
public hearing, which public hearing shall be
held not less than 30 nor more than 70 days following adoption of such resolution, (2) describe
the proposed boundaries of the redevelopment
district, (3) describe a proposed redevelopment
district plan, (4) state that a description and
map of the proposed redevelopment district
are available for inspection at a time and place
designated, and (5) state that the Governing
Body will consider findings necessary for the
establishment of a redevelopment district; and
WHEREAS, notice of such public hearing
shall be given by mailing a copy of the resolution calling the public hearing via certified
mail, return receipt requested, to the board of
county commissioners of the county, the board
of education of any school district levying taxes
on property within the proposed redevelopment
project area, and to each owner and occupant
of land within the proposed redevelopment
district not more than 10 days following the
date of the adoption of such resolution and by
publishing a copy of such resolution once in the
official City newspaper not less than one week
or more than two weeks preceding the date
fixed for the public hearing, which publication
shall include a sketch clearly delineating the
area in sufficient detail to advise the reader
of the particular land proposed to be included
within the redevelopment district; and
WHEREAS, upon the conclusion of such
public hearing, the Governing Body may pass
an ordinance which shall: (1) make findings
that the property within the proposed redevelopment district is an eligible area as defined
in the Act, (2) contain the redevelopment district plan as approved, (3) contain the legal
description of the redevelopment district, and
(4) may establish the redevelopment district,
provided that the boundaries of the redevelopment district shall not include any area not
designated in the notice of public hearing on
the creation of the redevelopment district; and
WHEREAS, no privately owned property
subject to ad valorem taxes shall be acquired
and redeveloped under the provisions of the
Act if the board of county commissioners or the
board of education levying taxes on such property determines by resolution adopted within
30 days following the conclusion of the hearing
for the establishment of the redevelopment
district that the proposed redevelopment district
will have an adverse effect on such county or
school district; and
WHEREAS, upon the creation of a redevelopment district pursuant to the Act, the
City may propose to undertake one or more
redevelopment projects and shall prepare a
redevelopment project plan, which may be
implemented in separate development stages,
in consultation with the Citys planning commission; and
WHEREAS, the Governing Body has heretofore adopted Resolution No. 2022-9, which
made a finding that the City is considering
the establishment of a redevelopment district
pursuant to the Act, set forth the boundaries of

Section 1.
Findings.
The
Governing Body hereby finds that notice of the
public hearing conducted June 14, 2022 was
made in accordance with the provisions of the
Act. Based on the information and additional
testimony received at the public hearing, the
Governing Body hereby further finds and determines that 50% or more of the structures in
the proposed redevelopment district described
in Resolution No. 2022-9 have an age of 35
years or more and may become blighted due
to due to the dilapidation and deterioration of
the structures and the presence of structures
below minimum code standards. As a result,
the area constitutes a conservation area and
is therefore an eligible area (as said terms
are defined in the Act), and the conservation,
development or redevelopment of such area is
necessary to promote the general and economic welfare of the City.
Section 2.
Creation
of
Redevelopment District. A redevelopment district is hereby created within the City in accordance with the provisions of the Act, which
shall consist of the real estate legally described
on Exhibit A attached hereto, which is incorporated herein by reference, to be designated as
the Guffey Properties, LLC Redevelopment
District (the District). A map depicting the
boundaries of the District is attached hereto
as Exhibit B, which is incorporated herein by
reference. The boundaries of the District do
not contain any property not referenced in
Resolution No. 2022-9, which provided notice
of the public hearing on the creation of the
District.
Section 3.
Redevelopment
District Plan. The preliminary plan for the
District (the District Plan), as presented to the
Governing Body this date and attached hereto
as Exhibit C, is hereby approved.
Section 4.
Approval of Other
Governmental Units. No privately owned property subject to ad valorem taxation within the
District shall be acquired and redeveloped
pursuant to the Act, if the Board of County
Commissioners of Anderson County or the
Board of Education of Unified School District
No. 365 determines by resolution adopted
within thirty days following the public hearing
held by the City on June 14, 2022, that the
District will have an adverse effect on Anderson
County or Unified School District No. 365,
respectively. If such a resolution is delivered
to the City, the Governing Body shall, within 30
days of the receipt of such a resolution, pass
an ordinance dissolving the District hereby
created.
Section 5.
Reimbursement.
The Act authorizes the issuance by the City
to issue bonds (the Bonds) to finance all or a
portion of the costs of implementing the District
Plan. The Bonds may be issued to reimburse
expenditures made on or after the date which
is 60 days before the date of passage of this
Ordinance, pursuant to Treasury Regulation
1.150-2.
Section 6.
Further Action.The
Mayor, City Manager, City Clerk, City Attorney
and other officials, employees and agents of
the City, including Gilmore & Bell, P.C., Bond
Counsel, are hereby further authorized and
directed to take such other actions as may

PROJECT AREAS
It is anticipated that all property within the
district will be designated as the project area
under the redevelopment project plan, which
must be adopted by the City Commission by a
2/3 majority vote before the expenditure of any
tax increment financing funds. The plans for
redevelopment of the project area generally call
for a full remodel or replacement of the current
structure into a single use retail building, and
associated improvements.
Tax increment financing may be used to
pay for eligible costs, including site preparation,
demolition, public infrastructure improvements,
such as streetscape, public parking, utility
extensions, landscaping, pedestrian and bike
paths and public plazas. Except as specifically
provided by the Act, tax increment financing
may not be used for construction of any buildings owned or leased to a private, nongovernmental entity.
SECTION 6: CONCLUSION
After the establishment of the redevelopment
district, any redevelopment projects to be funded with tax increment financing will be presented to the Governing Body for approval through
the adoption of a Redevelopment Project Plan.
The Project Plan will identify the specific project
area located within the established tax increment financing district and will include detailed
descriptions of the projects as well as a financial feasibility study showing that the economic
benefits out-weigh the costs. The Project Plan
must be reviewed by the Planning Commission
to determine if the Project Plan is consistent
with the intent of the comprehensive plan
for development of the City. Thereafter, the
Governing Body shall adopt a resolution calling
a public hearing to consider the Project Plan
notice of such hearing to be provided by mail
and publication in accordance with the. After
conclusion of the public hearing, the Project
Plan may be approved by ordinance passed by
not less than a two-thirds majority vote of the
Governing Body.
Tax increment financing does not impose
any additional taxes on property located within
the redevelopment district. All property within
the district is appraised and taxed the same
as any other property. However, if property
within the district increases in value as a result
of redevelopment, the resulting increment of
additional tax revenue is diverted to pay for a
portion of the redevelopment costs.

COMES NOW the plaintiff, by and through
James R. Campbell, Anderson County
Counsel, and for its cause of action against the
defendants alleges and states as follows:
1. Plaintiff is a body politic and corporate,
and is a duly organized and existing county of
the State of Kansas. A resolution, heretofore
adopted by plaintiff pursuant to K.S.A. 79-2801,
as amended, authorized the institution of this
proceeding to foreclose tax liens against real
property in Anderson County, Kansas, and
attached as Exhibit A. Said liens and real
property are more specifically described in
Exhibit B, which is attached hereto and incorporated herein by reference.
2. All requirements of law pertaining to
assessment, levy, taxation, publication and
proof thereof, sale and purchase in the name
of Anderson County, Kansas, as prescribed by
K.S.A. 79-2301 et seq., and every other legal
condition precedent to judicial foreclosure of
said tax liens, have been performed and satisfied. The taxes have not been paid as required
by law, and all the within described real estate
is subject to foreclosure and sale for delinquent
taxes.
3. The caption of this Petition is incorporated herein and made a part hereof by reference.
The persons named as defendants therein are
the owners or supposed owners, and persons
having or claiming to have an interest in the
lands described herein, so far as plaintiff is able
to ascertain, but the exact nature of such ownership and interest is unknown to the plaintiff.
4. Plaintiff further alleges that it has diligently inquired as to the residences and whereabouts of the defendants herein and, except
as set forth in Exhibit B attached hereto, is
unable to state the residences and whereabouts of the defendants, and each of them,
or whether any of them are dead, other than
indicated thereon, and, if they or any of them
be dead, plaintiff is unable to ascertain the
names, residences, whereabouts and identity
of the heirs, executors, administrators, devisees, trustees, conservators and assigns of
such defendants other than as indicated on
Exhibit B. Upon diligent inquiry plaintiff is
unable to ascertain whether the defendant corporations named herein are domestic or foreign
corporations, nor their legal status, nor whether
they continue to have legal existence and
officers, nor the names and whereabouts of the
successors, trustees or assigns, if any, of such
corporations as may be dissolved. All of the
defendants herein named, and those claiming
under or through them, should be required to
appear herein, so that all claims, estates, titles
and interests may be determined by the decree
of this Court and so that the tax lien therein to
be foreclosed may be adjudged a good, valid
and perfect first and prior lien upon each tract,
lot or piece of real estate described herein,
for the taxes, together with interest, charges,
penalties and costs thereon.
5. Exhibit B is a schedule containing
information pertinent to this proceeding and is
attached hereto, incorporated herein and made
a part hereof by reference. Each tract, lot and
piece of real estate intended to be included in
this foreclosure proceeding is described as a
separate item upon Exhibit B, and that each
such tract described upon Exhibit B also
carries a key number by which it is identified
in the files of the Anderson County Treasurer,
Anderson County Appraiser and Anderson
County Clerk.
6. Said lands described in Exhibit B are
all in Anderson County, Kansas. All of the
descriptions used in Exhibit B are intended to
indicate with ordinary and reasonable certainty
the real estate intended to be included in this
foreclosure proceeding.
7. Each item described upon Exhibit B is
also subject to charges occasioned by this foreclosure proceeding and to an equitable portion
of the costs of this proceeding to be fixed and
determined by the Court herein.
8. The plaintiffs lien is for unpaid taxes
on the real estate in questions and is a first
and prior lien to the liens and claims of all of
the defendants herein, including the unknown
members of the classes set forth in the caption
hereof. Plaintiff is unable to allege in greater
detail the nature of extent of the claims of any of
the defendants, and is unable to allege which,

Out west they are trying to
harvest as high as possible on
these short fields to maximize
stubble. Weeds are starting to
come in, so Ediger emphasized

right away to control weeds

shaded to prevent further

Weeds could also be an issue
in Ford County if a rain shower does pop up. One of the only
upsides to the drought it cuts

will include music, food trucks
and fireworks at Lake Garnett.
The City of Garnett invites you

Libertyfest on Saturday, July
2nd at Lake Garnett beginning
at 5 p.m.
Celebrating Independence
Day, a couple of days early,
the City of Garnett encourages
everyone to enjoy a little relaxation in your favorite lawn
chair, in the best spot you can
find at Lake Garnett. Enjoy
food provided by food trucks
and organizations on site, while
listening to music provided
throughout the evening and
during the fireworks by Everett
Cox. Bring your cornhole board
games and enjoy this celebration. Camping is available in

Bures told the Review in an
email he had seen the post but
had opted not to comment.
The move is unprecedented in at least the preceding
30 years of city operations.
While the resolution itself is
not binding and cannot effect
direct action on city staff, it is a
statement of support and direction by the citys elected leadership for the theme it conveys,
and provides what Sheahan
described as formal support for
the city manager to make the
changes necessary. In order for
a resolution to be adopted it
must be voted on by the three
commissioners.
Sheahans post said various members of the public had
offered to volunteer for certain
duties in Parks & Rec while
personnel changes were occurring.
Bures was recreation director in 2014 when he and thencity manager Joyce Martin
crafted a plan to meld the recreation coordinator duties
basically running youth sports
programs into the rec director
post which handled administrative duties of the city rec
facilities such as overseeing
the parks, recreation center
swimming pool and cemetery
departments. Those duties
were formerly handled by the
recreation coordinator.
In 2015 Bures was slightly
injured when a chemical explosion occurred in the pool house
at the city pool. In 2019, Bures
asked commissioners to reinstate the rec coordinator position to again take over managing those youth programs.
Any person concerned with this request
may attend the public hearing or submit
written comments, opposed or in support,
to the Planning Commission. The Planning
Commission may continue this hearing date
$12,000 Kansas Department of
Revenue tax warrant in April
for allegedly failing to pay tax
on marijuana and controlled
substances. Court documents
show the warrant levied
against a pickup apparently
owned by the individual in lieu
of payments for the tax.
Anderson County Attorney
Elizabeth Oliver said the
charges were filed Thursday.
Charging documents were not
yet available over the weekend
on the district courts record
system.
Briggs is a candidate for
governor in the Republican primary against Kansas Attorney
General Derek Schmidt.
