GARNETT Favorable rains
and weather have combined
for a solid outlook for the 2017
corn and soybean harvest in
Anderson County and elsewhere in Eastern Kansas.
That news comes as some
analysts say the nationwide
corn crop will be about a billion bushel off the 2016 record
harvest.

a Kansas Attorney Generals
report says the school board
was inattentive to its responsibilities, committing technical violations of state open
meetings law, but not deliberate ones.
The issue surrounded certain language in the districts
meeting agenda, possibly
present in that from years
ago and carried forward on
subsequent agendas for more
than a decade. The language
of the motion amounted to a
broad encapsulation of possible topics for which the board
could close the open meeting,
rather than specifically noting the topics to be discussed.

drove an alleged runaway vehicle into a local truck stop July
4 and fatally injured a Garnett
man is still in Anderson
County Jail awaiting a Sept. 19
court appearance, where attorneys and the prosecution will
try to cut a sentencing deal to
avoid a trial.
Andrew Holstine, 27 of
Garnett, has been held at the
Anderson County Jail in lieu
of a $100,000 bond since he was
apprehended after fleeing the
scene the night of the incident.
Lloyd Sutton, 75 of Garnett,
died hours later from injuries
he sustained when the car

since the early 2000s. The number nationwide for that term is
over 14,000 some 3,100 were
under the age of 16.
As ATVs have become
more popular in recent years,
statistics show around 650
Americans annually have lost
their lives to the vehicles. More
than 93,000 a year in the last
two years of official data ended
their ATV outing with an emergency room visit.

Motorsports Weekend at Linn
County Fair dubbed a huge success

Rodeo jumps in to full swing
this week when 400 plus
head of 4H and FFA livestock
arrive on the Mound City, KS
Fairgrounds.
Grandstand activities for
the 147-year-old county fair,
one of the five largest in
Kansas, began Aug. 4 and conclude with the PRCA Rodeo
Fri. and Sat., Aug. 11-12.
Figures for attendance
and entries this past weekend, dubbed the 3-Day
Motorsports Weekend will
probably be a record according to fair board officials. The
crowd at the Friday 2-Car
Team Demolition Derby was
up 30% over last year stated Kelly Carbon, fair board
president. The grandstands
were near capacity for the
Saturday, Aug. 5 Demolition
Derby and the Sunday, Aug.
6th Outlaw Truck and Tractor
Pull.
72 demolition cars competed in the two nights of
demo derby action. Purse
money totaled $6000.00 for the
Friday team car competition

Kobach, Trump on right
track with RAISE Act
There is of course a huge difference in the
public discussion of illegal and legal immigration and the impact of both on our nation, but
the public debate confuses the two and confuses
what should be the logical objectives of policy
dealing with both.
The point gets lost in the woods. Why do
nations have policies dealing with immigration
at all? When we step back to answer the question
the objective is obvious: Like any other policy
our leadership would seek to pursue whether
on defense, economics, highway infrastructure,
etc., the target should be the benefit of our nation
and the people living in it.
That America is a great opportunity for immigrants is secondary, and should be.
In that vein, its clear that the Reforming
American Immigration for a Strong Economy
(RAISE) Act now beginning a path through
Congress is such a common-sense piece of legislation that it will have absolutely no chance of
becoming law whatsoever.
It is however being embraced by clear thinkers because it attempts to craft the nations legal
immigration policy into something thats actually good for our economy, instead of a feel-good,
glowing chorus of Kumbaya that makes us all
warm and fuzzy about how tolerant and inclusive we are.
Kris Kobach, Republican candidate for
Kansas governor who conferred with the Trump
Administration and with Congress on the legislation, sees the value in prefacing our policy
on points that admit better immigrants who can
make our country better. Thats a feather both
in Kobachs cap and that of Trump and his legislative supporters. RAISE awards preference
points for prospective immigrants based on their
level of education and technical skills, earning
ability, their youth and their accomplishment as
English speakers, among other factors.
The idea is that we want to be more exclusive
in who we allow into the country we want
people who will succeed here and help make our
nation successful and be beneficial to our economy. Thats important, because 51 percent of all
present immigrant households (either legal or
illegal) are beneficiaries of at least one federal
government welfare program compared to 30
percent of native born households. That doesnt
include state programs.
The RAISE Act would also reduce the number

of legal work visas or green cards issued per
year from a million to an estimated 500,000. It
would eliminate Diversity Lottery Visas, a
program that grants 50,000 visas per year for
the purpose of diversity to countries that
generally send few immigrants here. It would
eliminate the ability for immigrants to sponsor
visas for extended family members and adult
children. It would also adapt a work visa system
to one similar to those in Australia and Canada
that establish a point system to give priority to
younger applicants with established English
skills, high-paying job offers and other high levels of achievement that can benefit our nation.
The Act will of course be opposed by
Democrats and by the mainstream media with
charges of classism and elitism, first of all since
it is offered by Republicans and supported by
Trump and second because Kobach contributed
to it. Big Government-types need those poor
immigrants, just like they need the remainder
of poor and dispossessed Americans, to carry
the banner for the Welfare State and to vote to
maintain it.
For Kobach, RAISE illustrates a clear philosophy that government should steer a path toward
practicality, accomplishment and achievement
that benefits the American people first before
providing benefit to those with little to offer.
Its an objective thats easy for other nations to
embrace, and its a laudable point in Kobachs
favor as Kansas governor.

Venezuela is a woeful reminder that no
country is so rich that it cant be driven into
the ground by revolutionary socialism.
People are now literally starving — about
three-quarters of the population lost weight
last year — in what once was the fourth-richest
country in the world on a per capita basis. A
country that has more oil reserves than Saudi
Arabia is suffering shortages of basic supplies.
Venezuela now totters on the brink of bankruptcy and civil war, in the national catastrophe known as the Bolivarian Revolution.
The phrase is the coinage of the late
Venezuelan strongman Hugo Chavez, succeeded by current Venezuelan strongman Nicolas
Maduro, who has instituted an ongoing selfcoup to make his country a one-party state.
The Chavezistas have worked from the typical communist playbook of romanticizing the
masses while immiserating them. Runaway
spending, price controls, nationalization of
companies, corruption and the end of the rule
of law — its been a master class in how to
destroy an economy.
The result is a sharp, yearslong recession,
runaway inflation and unsustainable debt.
The suffering of ordinary people is staggering, while the thieves and killers who are

will be nothing left to steal.

Maduro is getting around this problem by ending Venezuelas democracy. The Chavezistas
slipped up a year or two by allowing real
elections for the countrys National Assembly,
which were swept by the opposition. They

stripping it of its powers and culminating in
a rigged vote last week to elect a constituent
assembly to rewrite the constitution.
The goal of Maduros alleged constitutional reforms is to no longer have a constitution worthy of the name. Denied the ordinary means of dissent via the press and elec-
tions, the opposition has taken to the streets.
Already more than 100 people have been killed
in clashes over the past several months. Worse
is yet to come. Lacking legitimacy and representing only a fraction of the populace, the
Maduro regime will rely on the final backstop
of violent suppression.
There is no easy remedy to Venezuelas
agony. If meditation were the solution, the
country never would have gotten to this pass.
Endless negotiations between the government
and the opposition have gone nowhere. The
U.S. needs to use every economic and diplomatic lever to undermine the regime and
build an international coalition against it.
We should impose more sanctions on specific officials and on the state-run oil company;
we should advertise what we know about the

Governors resignation means intrigue in Topeka
As a dutiful lieutenant governor, Jeff Colyer
has been a strong supporter of the policies and
whims of Gov. Sam Brownback.
And now the question is, with Brownback
likely off to serve President Donald Trump
as ambassador-at-large for international religious freedom, just what a new governor
wants to accomplish in the 2018 legislative
sessionand how that plays out politically for
statewide office-seekers and members of the
Kansas House of Representatives.
Practically, Brownback is gone. A former
U.S. senator, hes going to be confirmed by the
U.S. Senate for the post, and Colyer becomes
governor through the rite of succession.
No, Colyer hasnt said whether he wants to
stand for election to a full term as governor.
Might, might not, probably will, but only
Colyer knows for sure yet. There is already a
primary election brewing for the GOP nomination for governor next year, and few are
thinking that conservative Secretary of State
Kris Kobach will demur to the guy who may
need a couple months as the governor to
decide whether he likes the job enough to
want it for a full four-year term.
Youll notice that last week no candidates
for the GOP nomination have folded their
campaigns.
AndColyer will become governor with
most of next years budget already appropriated, part of Brownbacks biennial budget
program that makes the last year of that cycle
basically tuning up whats been appropriated.
Oh, that last year of the two-year budget cycle
that Colyer will have to fix shows about a
$90 million shortfall, so hes going to have to

either think up some new revenue source or
cut that amount from the upcoming fiscal year
budget.
Nowthat in itself will probably tell
Statehouse insiders how popular Colyer will
be. Last session, recall, with the state facing a $200 million-plus shortfall, Brownback
essentially told the Legislature just fix it.
Brownback didnt make any budget cuts that
would have his fingerprints on them, instead
apparently went to lunch, forcing the newly
elected Legislature to make its own cuts that
will splash back on legislators at next years
elections, when they have to look good for
constituents. Notable? Had Brownback made
the unpopular budget cuts there would have
been no political damage for him because he
couldnt run for reelection to a third (whew)
term, anyway.

and this is the time of the season when current cabinet secretaries start thinking about
what to do in the future. Holding onto those
cabinet secretaries is good, they know how to
run things, if they are running things the way

Yes, at least for those folks who spend their
time in the Statehouse, or who depend on
what happens here, there are going to be some
changes coming up, some subtle, some maybe
not, but the real angst the next month or two
will be waiting to find out just what theyll be.
Oh, and Democrats? They have lost the
most powerful weapon that they can use to
elect more House members and a new governorBrownback. Even though he wouldnt
have been on the ballot next year anyway,
the Brownback supporter bullet point likely comes off Democrats campaign materials
about their opponents, and depending on how
Colyer works with Democrats in the upcoming legislative session, the personality issue
fades.
Its going to be just a change in business
cards for Colyer, but one with significant governmental and political consequence.

I would like to respond to the article entitled
New city manager wants faster, more transparent budget. Im proud of my years of service and
mean no ill will towards anyone; Im just trying
to defend my decisions and those of other former
managers. The article says that past city budgets
havent been filed in a timely manner. State statutes suggest that hearings be held no later than
August 15 and filed with the county clerk no later
than August 25. There are no penalties imposed
if these dates are not met. Meeting these dates
became harder and harder and a few years ago I
joined with other cities to petition the legislators
to extend the suggested deadlines to
give us more reliable revenues to
prepare estimates
for the current and
following year. No changes were made at that
time. The Department of Administration was
contacted and their reply confirmed that the
August dates were not absolute and suggested
that the cities stay in contact with their county
clerks to make sure their deadlines are met so
levies could be set and tax statements prepared.
No one took the preparation of the citys budget
more to heart than I did. I never took this part, or
any part of my job, lightly.
The second part of the article dealt with Charter
Ordinance #3 which was adopted by the then
governing body in May of 1968. There have been
seven city managers since the adoption of this
charter ordinance. In reviewing this ordinance
and talking with a former Garnett city manager,
I believe the provisions set down have been followed in the 49 years of the ordinances existence.
I was so proud to work for every manager the
city had in the past. They taught me so much and
most of all to listen and learn. If the new manager
makes the changes he is proposing then, yes, this
particular ordinance will have to be amended.
Interpretation of any ordinance is very important
and it is my understanding that the city attorney
is researching this matter.
Friends and family encouraged me to write
this letter because I wasnt sure what to do. I
hope to continue working in a volunteer role to
support the community foundation, the Walker
Art Committee and all the many great things
this community has to offer. Hopefully this letter
doesnt distract from my being able to do that.
I appreciate all the support given to me over
the years and most importantly the last few days.
My goal has always been to work hard, play by
the rules, follow local, state and federal laws to the
best of my ability.

The transition to the new 785 area code begins – 20 years ago

Just three days after bonding out of jail to await court
dates for multiple counts of
theft, 20-year-old Carl Damron
of Garnett was back in the local
slammer for allegedly stealing
a 2002 Harley Davidson motorcycle from a man who had been
his alleged victim once before.
Now the local court system is
tallying up the charges, separating old for the new, and
getting ready to determine just
what rewards this frequent
flyer will earn when its all
said and done.
20 years ago…
The advent of the new 785
telephone area code for most of
Anderson County and the western portion of Kansas will be
an unnoticeable and seamless
transition, Sprint officials say.
As of July 20, both the present
913 and the new 785 area codes
will be acceptable for long distance calls, and the dual codes
will function together until
October 1, 1998. That 15-month
period will allow telephone
customers a grace period to
make the transition from the
old to the new area codes.

gunshot wound at his residency by officers responding to a
phone call. Byers was originally
from Cody, Wyoming, and was
employed by the Welda branch
of the Williams Brothers

Kellerman, the Kansas Bureau
of Investigation still has the
matter under investigation
and no other information is

The tables were decorated

on the table. Hot dogs, lemonade and yummy side dishes and desserts were served.
Fourteen members were present.

favorite school teacher they
had while attending school.

to have a garage sale in

Hamilton were united in marriage on August 13, 1967 at
the First Baptist Church in
Leavenworth, KS.
They moved to Garnett in
the summer of 1969 and made
their home on their family
farm southwest of town. This
union was blessed with one
daughter, Denise Hamilton of
Winfield, KS.

these new forms of ID three
years ahead of when its
required by the federal government for airport security purposes, so we can take
advantage of the normal renewal cycles for most Kansans,
said Revenue Secretary Sam
Williams. Theres no need to
rush in for a new ID, but its
something the public needs to
be aware of.
To obtain a federally compliant Real ID credential,
Kansans should bring proof of
social security number documentation in addition to their
birth certificate or valid U.S.
Passport. If they do not have
those documents on hand, they
can choose to obtain the not
for federal ID card that will
not be acceptable ID for boarding domestic flights or entering designated federal facilities after September 30, 2020.
However, the not for federal
ID cards will still be valid as
state ID or as a drivers licenses.

the motion for recess by the
October 2016 meeting, a move
Sheahan said recently he was
satisfied with.
But Sheahan said the issue
denotes an over-reliance by
board members on superintendent Don Blome, and a lack of
receptivity to patrons participation.
I am happy to see that the
AG followed through with the
investigation and the school
board has acknowledged their
mistakes and made changes, Sheahan said. I wish the
board would have been more
receptive to input from their
constituents, which would
have prevented the AG from
getting involved. Hopefully, in
the future, the board and staff
will listen a little more and dismiss constituents a lot less.
Sheahan said his experience
early on with the school board
seemed to reinforce a theme
hed heard from the community that the board turned a deaf
ear toward patron concerns.
In USD 365 it appears the
school board reports to the
superintendent and rubber
stamps his decisions, Sheahan
said.
Blome said the district has
tried to maintain a policy in
keeping with open meetings
laws.
I feel comfortable with the
report, Blome said Friday.
The district always makes an
effort to comply with the intent
of the open meeting requirements as indicated in the opinion. The school district posts
its meeting agendas and minutes on its website for public
viewing monthly and meeting
are open to the public.
Max Kautsch, a Lawrence
attorney who represents the
Kansas Press Association in
open government issues, was
in agreement with the AG opinion.
It looks like the board was
trying to comply and they
just werent technically doing
so, Kautsch said. He said the
21-page report showed the AGs
office had been very detailed in
its review, showing attention
to the issue which other complaints have not received in the
past.
The Attorney Generals
office should absolutely be
commended for such a thorough review and in trying to
clarify these requirements,
Kautsch said.
Board member Cleon Rickel
said USD 365 was quick to act
on the change.
The board has always tried
to do the right thing in overseeing district operations and
setting policies, Rickel said.
The attorney generals office
requested that we change the
procedure for going into executive session and the board was
happy to do so.
Personally, now that Ive
seen the change in action, I
think it makes things a bit
clearer for the public. I think
its been a good change, Rickel
said.
Assistant Attorney General
Lisa Mendoza wrote in the
opinion that with its October
2016 meeting the board amended its executive session motion
language to state only one
subject for the meeting. She
said while multiple topics can
be discussed in an executive
session, public boards should
be realistic about time limits
and inclusive in the subject
matter for the closed sessions.
That lack of specificity in the
motions dated back to at least
2015, Mendoza said, in the
offices review of past meeting
agendas.
The number of technically
deficient motions for executive
session identified in this case
suggests the board has been,
at the very least, inattentive
in meeting the requirements
of the Kansas Open Meetings
Act, Mendoza wrote, and
overly reliant on the superintendent to ensure that it
meets the requirements of the
KOMA.
However, in mitigation, we
note that the board has already
taken corrective action concerning its motions, she said,
and acknowledged its shortcomings.
The report directed USD 365
to submit a report to the AGs
office outlining an establishment of a checklist or other
process to ensure the board
meets all statutory elements
for recessing into closed session each time it calls one, and
review and update its policies
for calling executive sessions
to ensure they comply with the
requirements of KOMA.

of Sandras Quick Stop toward
a parking spot with Holstine
yelling from the window that
he couldnt stop the car. It
smashed into the park bench
where Sutton and another man
had been sitting. The other
man escaped serious injury.
Holstine, who was driving
with a suspended license, fled
the scene and was later apprehended. He faces felony counts
of involuntary manslaughter
while under the influence of
narcotic drugs, failure to stop
at an accident and possession
of methamphetamine.

shared with me a list of five
ways to die on a golf course.

While none of these possibilities is pleasant to contemplate, the threat of skin
cancer is real and should be
considered carefully.
Every year one million
new cases of skin cancer
are detected, according to
the American Academy of
Dermatology. One out of five
people in this country develops skin cancer during his/
her lifetime.

with their families many of
these trips include trips to the
beach or outdoor amusement

Kansas gas prices expected
to continue to climb
through the end of summer
Gas prices across Kansas
continue their steady increase
this summer, jumping 5 cents
from a week ago to $2.22/gallon, according to AAA Kansas.
This comes a week after a 6-cent
statewide increase.
This weeks Kansas cities with the states gas price
extremes are at far opposite
corners at the state.
The highest price was in St.
Francis (Cheyenne County, far
Northwest Kansas) – $2.49
The lowest price was in
Columbus (Cherokee County,
far Southeast Kansas) – $2.03
Of the 10 regularly reported
Kansas cities (see chart below),
all experienced price increases in the past week, AAA
Kansas notes. Kansas City,
Kan. and Lawrence led the way
with 10-cent increases, while
Manhattan, Salina and Topeka
each rose only one cent from
last week.
At 13 cents less than the
national average, Kansas gas
prices are still 12th lowest in
the country, said AAA Kansas
spokesman Shawn Steward.
Strong gasoline demand
across the country is continuing to push prices higher at
the pump, a trend that we dont
see letting up through the end
of summer, said Steward.
Kansas is still in a good position, though, with relatively
affordable gas prices, compared
to the national average.
Todays national average
price for regular unleaded gasoline is $2.35/gallon, which
is three cents more than last
week, nine cents more than
one month ago, and 23 cents
more than at the same time
last year. The latest Energy
Information Administration
(EIA) report shows gasoline
demand reached a new weekly
record of 9.842 million b/d. The
2017 demand average over the
past four-weeks is about one
percent ahead of the same fourweek period last year. With
summer demand running full
steam ahead, drivers can expect
prices to continue rising.
Duplicate bridge played

Kansas Reading Roadmap hosts
annual conference to focus on
improving reading proficiency
among Kansas students
TOPEKA Nearly two-thirds
of U.S. fourth graders are not
proficient readers, according to
a national reading assessment
data. Fortunately, The Kansas
Reading Roadmap (KRR), an
initiative focused on improving reading proficiency among
Kansas grade school students,
is actively working to combat
the issue by providing an integrative framework to support
Kansas schools and make sure
that every child graduates on
time and achieves his/her full
potential.
This week, KRR held its
annual kick-off conference in
Wichita. The event ran August
2nd and 3rd. The meeting consisted of representatives from
all 60 KRR sites in Kansas.
The focus of this years conference was Kansas Third
Grade Assessments and maximizing test scores. Some of the
key speakers at the annual conference were Executive Director
of Kansas Parent Information
Resource Center Jane Groff,
Boys & Girls Club President
Dave Smith and Director of
Grade-Level Reading Support
Center Campaign for GradeLevel Reading Ron Fairchild.
KRR was commissioned by
Governor Sam Brownback
and is funded by the Kansas
Department for Children and
Families (DCF). KRR also
works in partnership with
the Kansas Department of
Education (KDOE), 34 local
schools and local partners.
Currently, KRR is working
in 28 counties, including Allen,

Eleven Years Ago
It was August 22, 2006 when
Colony lost a three quarters
of a century-old local business
that was consumed in flames.
A fire started in the old grain
mill of Colony Grain, LLC. The
elevator started operation in
Colony in 1930. Allen and Coffey
County fire departments were
summoned to the blaze that
began around 9 a.m. Days after
the fire was brought under control, smoke still rose from the
smoldering debris. It had quickly spread to the office area of
the building. Several volunteers
helped remove records from the
office until conditions were no
longer safe. Everyone escaped
uninjured. The company had
insurance but they were unsure
of the elevators future. Today it
remains barren. It was hard on
farmers to have lost this busi-
ness. But where there is a will;
there is a way. Our farmers continue to work

My daughter, Cheryl Luedke,
of St. Augustine, Fla. suffered
injuries when she had a hard
fall while walking a dog. She
was pet sitting among her
many duties when the accident
occurred. She underwent x-rays,
etc. at the local EMT where they
patched her up and she is home
and back to work slowly.
I enjoyed my happy birthday this month and three days
later my son, Mark, enjoyed his
birthday. Thank you to those
that remembered.
Sharon Smith has been on the
sick list but is doing much better
now.
Dian Prasko recently vacationed and visited relatives and
friends in the state of California.

In my opinion, the renewable diesel project may have similar
results as the Wood Project we invested in Georgia.
