Mail-in election
enters final week
Decision on 5-member
city commission change
to be rendered Aug. 14

THE ANDERSON COUNTY REVIEW
GARNETT Registered voters in the city have until next
Wednesday, August 14, to have
their votes counted to determine
whether Garnett will expand to
a five member or remain with a
three member city commission.
Ballots in the mail ballot election were mailed July 25, with
a return deadline of 12 noon
Wednesday, August 14. Any registered voter who did not receive
a ballot in the mail and wants to
cast a vote on the issue should
contact the Anderson County
Clerks office at (785) 448-6841.
County clerk Julie Wettstein
said only a half dozen new voters
registered in time for the mailout election between July 15 and
24. As of last week some 400 ballots had been returned, she said.
Some 1,020 voters, according to
initial vote totals, cast votes and
approved the measure 53-47 percent when the advisory question
was voted in November 2018.
The issue has been a point of
contention between city commissioners and members of the public since commissioner Brigitte
Brecheisen-Huss drummed up
the idea and the commission
voted to place it on an advisory
ballot in the fall 2018 election.

GARNETT Both the amount
of delinquent taxes owed to
Anderson County and the number of parcels involved are down
as of the 2018 tax payment deadline probably the result of a
more aggressive stance by the
county in pressing tax foreclosure efforts.
The list of 2018 delinquencies published on pages 2B &
3B reflects a total of 482 parcels,
down from 533 last year, with
total tax owed at $328,769 compared to $398,004 last year. Its the
first drop in delinquent taxes in
recent years.
The list includes properties
processed and set for foreclosure and liquidation in a county tax sale recently published
and expected to be held in
September. Harold Deforest with
the Anderson County Treasurers
office said six of the last 23 parcels
that have been removed from that
scheduled tax sale had the taxes
paid in full, which accounts for
some of the reduction in tax owed
overall between the two years.
In a nutshell, there were 51
less parcels and $69,234.80 less in
total delinquent taxes this year,
Deforest said.
Delinquent parcels and taxes
had climbed the past two years,
including a 24 increase in delinquencies owed from 2016 compared to 2015. The $398,000 figure
last year was the highest since
the immediate post-recession
summation in 2010, when county county taxpayers still owed
$372,347.

LINCOLN, Neb. The former
Garnett man facing federal child
pornography charges in Nebraska
will be sentenced October 25, after
cutting a deal with federal prosecutors last week.
Michael Dean McCullar, 47
of Dwight, Neb., and formerly of
Garnett, pled guilty to two of four
counts against him in exchange for
prosecutors dropping the other two.
McCullar was indicted in
February on a charge of production
of child pornography, two counts of
distribution of child pornography
and one count of possession of child
porn. Under the plea agreement
reached last week, McCullar pled
guilty to one count of production of
child porn and a single count of possession, throwing out both charges
of distribution. Maximum sentences
can include fines up to $250,000 and
imprisonment of up to 20 years on
each count.
McCullar
was
arrested
during a Florida business trip in
February, after Homeland Security
Investigators over a series of months
identified him in
an Internet sting
operation as a deep
web persona offering to sell or trade
nude photos of a
girl they estimated about two years
of age. On October
25, 2018, Homeland
McCullar
Security officers in
Boston were able
to procure 10 photographs of the
child being exploited by a white man
with dark arm hair wearing a wedding ring. The photos were provided
by a username later identified as
McCullar through his internet connection.
Investigators were able to ascertain a fingerprint from the photo of
one of the hands in the photos which
was run through two crime data
bases. Both came back negative.
Officers
confirmed
with
McCullars wife, Christine McCullar,
the identity of the child as her niece,
whom she said Mike McCullar had
periodic access to. In his anonymous conversations with officers
online, McCullar said he had been
abusing the girl since she was eight
months old, but planned to cease the
activities when she got older so she
couldnt report the abuse.

and obtained by the Review said
Christine McCullar identified other
background items from the photos
shown to her, like a blanket and bed
pillows, that provided further evidence in her husbands arrest and
charges.
McCullar was a regional manager
for a national medical services company and worked from his home in
Garnett before moving to Nebraska
several years ago. At one time he
was chairman of the Anderson
County Republican Party.

for every federal crime by statute,
with certain ranges determined
between those parameters. Judges
may consider various information
during their deliberation to come up
with a sentence determination.
fees charged to State of Kansas
TOPEKA The federal government
must repay Kansas more than $56
million for illegally collecting an
Obamacare fee from the state over a
three-year period, a federal district
court judge in Texas ruled yesterday.
In 2015, Kansas Attorney General
Derek Schmidt and five other states
sued the federal government, arguing
that the Health Insurance Provider
(HIP) Fee one of the numerous taxes
and fees imposed by the Affordable
Care Act, or Obamacare was being
illegally collected from their state treasuries. Federal statute expressly prohibits the imposition of the HIP fee on
states. But in states like Kansas that
contract with private managed care
organizations (MCOs) to operate their
Medicaid programs, the federal government imposed the fee on the MCOs,
then adopted a regulation requiring
the MCOs to pass the cost of the HIP fee
through to the state.
As weve argued from the beginning of this case, the two-step HIP
Fee scheme illegally taxes treasuries
in states like Kansas to pay for federal expenditures, and the unlawfully
collected amounts must be returned

Federal District Judge Reed
OConnor ruled in March 2018 that the
regulation mandating the MCOs pass
the cost of the HIP fee through to the
states was illegal. In August 2018, the
judge ordered the federal government
to return to the states the money it had
illegally collected.
Since then, the states and the federal government have been in discussions about the amount of money at
issue. For Kansas, the court originally
identified more than $142 million in
total payments illegally collected, but
a portion of that was paid by the state
with federal funds. The $56,555,998 now
entered in final judgment for Kansas
is the net amount paid from state taxpayer funds over the three-year period
for Fee Years 2014-2016. The federal
government has now agreed not to
challenge the amount of money to be
returned to Kansas under yesterdays
judgment it will only appeal whether the payment must be made at all.
The federal government suspended
collection of the fee in Fee Year 2017.

Chairman Jerry Howarter called
the meeting of the Anderson County
Commission to order at 9:00 AM on July
29, 2019 at the County Commission
Room. Attendance: Jerry Howarter,
Present: David Pracht, Present: Leslie
McGhee, Present. The pledge of allegiance was recited. Minutes from the
previous meeting were approved as
presented.
County Treasurer
Dena McDaniel, County Treasurer,
and Harold Deforest, Deputy County
Treasurer, met with the commission.
Harold is in charge of IT issues that
the departments have and Dena would
like to see his pay increased for the
amount of IT work that he is doing. She
requested that the IT pay be increased
to $6,500 per year and would be included when COLA raises are given. The
Commissioners agreed to increase the
salary for the 2020 budget year and
be included with COLA raises in the
following years.
Sheriff
Vern Valentine, Sheriff, met with the
commission. He expressed his concern
with Windows 7 expiring and having
to update to Windows 10 to maintain
security. The current computers that
are in the jail are 7 or 8 years old and
need to be replaced. The purchase of
new computers will eradicate the security issue with having the most current
software. He received a quote from
Advantage Computers for 21 computers of $16,210. Commissioner McGhee
moved and Commissioner Pracht seconded to purchase 21 new computers
with Windows 10 for $16,210 to be paid
out of the Jail/Sheriff Reserve fund. All
voted yes.
Rural Fire
Mick Brinkmeyer, Rural Fire
Supervisor, met with the commission.
He discussed the station at Lone Elm.
The building is in need of major repairs
and houses a brush truck. Currently,
there is no one nearby to utilize the station or equipment. The Commissioners
instructed Mick to move the truck to a
surrounding location and contact the
City of Lone Elm to see if they could
utilize the building.

$400,000 and the commissioners felt
that was too much. Mick suggested
rejecting all bids and begin rebidding
for a non-coded building with improvements. Commissioner McGhee moved
and Commissioner Pracht seconded
to reject all Welda fire station bids and
to rebid for a non-coded building with
improvements. All voted yes.

Cole opposed Huss and Greg
Gwin in their efforts to codify the advisory election vote
into a revised city charter by
circulating a petition to force
the measure to a binding vote.
That petition succeeded, which
spawned the mail ballot election.
Even the form of the election
erupted into discord when city
attorney Terry Solander counseled the commission that the
vote needed to be conducted as
a walk-in election at the polls,
per the Kansas Constitution
in dealing with charter ordinance votes. Holding the election as a mail-in vote, Solander
said, risked litigation based on
those grounds and the possible
recension of the vote if such a
suit succeeded in court. Huss
and Gwin ignored Solanders
protest and voted 2-1 against
Cole to pursue the mail-in vote
anyway.
Cole has said she opposes the
expansion due to added costs of
some $11,000 per year for com-
missioners salaries. Huss said
she proposed the measure to
broaden resident representation on the commission, and
Gwin said while he did not
initially support the idea, he
was convinced by the Fall 2018
advisory vote to support the
measure because thats what
the public had voted for.
If the measure fails, the

so Kansas cannot yet count on
this money being available.
The federal governments
appeal will be heard in the 5th
U.S. Circuit Court of Appeals
in New Orleans. In addition to
Kansas, the states that brought
this lawsuit are Texas, Indiana,
Louisiana, Nebraska and
Wisconsin. The finalized judgment requires the federal government to return more than
$479 million to the six states
that brought the lawsuit.

August 2, 2019, at Richmond
Healthcare, Richmond, Kansas.
It was in the Oklahoma community of Maud where Juanita
Mae Tyler was born, on
February 28, 1930. Her parents
were Eldren Cecil and Laura
May (Patterson) Tyler.
Juanita and Lawrence
Gerald Kellerman were married on September 17, 1949, in
Shawnee, Kansas.
Funeral services will be held
at 10:30 AM, Tuesday, August
6, 2019 at the First Christian
Church, Garnett. Interment
will follow in the Garnett

Community Care Network
of Kansas includes health centers and community care clinics serving the medical, dental
and behavioral health needs of
approximately 300,000 Kansans
each year. These providers of
choice are delivering innovative, community-based care
that increases patient choice
and access to care and expands
the spectrum of behavioral and
oral health providers statewide. Fifteen community care
clinics are providing schoolbased services in 28 school
districts statewide, increasing access to health care for
37,000 students and their fam-
ilies. By expanding health
care access for children in the
school setting, community care
providers are building stronger individuals, families and
communities, Cyzman said.
As a major primary care
provider for Medicaid and
the uninsured, some community care clinics are the only
Medicaid provider in their
community and sometimes

REMEMBRANCES
How are we to build the church?
We often wonder how we
are to build the church? I
believe Jesus left us the perfect
example in Acts 2:42-47. The
book of Acts is a continuation
of Lukes gospel where Luke
intends to show what Jesus
began on earth he intends to
do in the life of the church. If
we examine the text we see
that the early church was a
learning community. They
devoted themselves to the apostles teaching and to fellowship,
and to the breaking of bread
and to prayer. (2:42) What
Luke is telling us is the early
church emphasized three keys,
Biblical exposition, the sacraments, and prayer.
The early church was also a
sharing community. All the
believers were together and
had everything in common.
Selling their possessions and
goods, they gave to anyone
as he had need. (2:44-45) I
believe what Luke is saying
here is very much what should
take place today. Out of what
the church collected they reinvested into the people and to
others who were not necessarily part of the community but
had legitimate needs.
We read the early church
was a worshiping community.

our worship today consists of
watching. Most people never
touch a Bible or a hymnal as
everything is presented on a
screen. In one sense this can
detract from our worship of
God.

was a growing community.

The occasion for the assault on McConnell
was a naked and cynical political setup. After
Robert Muellers testimony, Democrats tried
to get so-called unanimous consent for election security bills in the Senate. This procedure is reserved for uncontroversial items

that, as you might guess, have unanimous
support. While everyone in the Senate agrees
we should combat Russian interference, not
everyone agrees on how to do it.
One of the Democratic bills would mandate the use of paper ballots as a fail-safe
against hacking. This may well be the best
practice, but running elections is the responsibility of states and localities, not the federal
government. As supporters of state prerogatives, Republicans could be expected to oppose
the bill, and sure enough it only got one
Republican vote in the House.
Another bill would require campaigns to
report offers of foreign assistance, a superficially appealing idea. Yet, the more compre-
hensive such a bill is, the more likely it is to
sweep up minor and innocent interactions
that fall far short of the infamous Trump
Tower meeting (that itself came to nothing).
`Theres no need to reach for extravagant explanations for why McConnell would
oppose these bills (Hes a tool of the Kremlin!
He hopes his Moscow minders will put Trump
over the top in 2020!). The Kentucky senator
has an extensive record as an opponent of federal activism and of poorly drafted campaign
reform bills.
What the case against McConnell comes
down to is the usual sophomoric Washington
argument that if you dont want to do this one
specific thing, you dont want to do anything
and have the worst possible intentions.
McConnell supported the $380 million to
aid in election security funding that passed
Congress. And he supported the bipartisan
Senate Intelligence Committee investigation
into election interference that produced an
alarming public report late last month.
As McConnell pointed out in a peppery
defense of his record on the Senate floor, hes
been a Russian hawk going back to the Reagan
administration, and has continued to call out
Putin since 2016.
He doesnt need lessons from anyone about
how to be cleareyed about Russia, let alone
how to be patriotic.

deceased or owners are simply chronic delinquents whove
shown no interest in paying.
The difference this year, the
data hints, is that the threat of
an impending foreclosure and
sale of some of those properties
prompts owners of more valuable delinquent parcels to pay
up and clear the slate before the
properties are seized and sold
for the taxes owed.
State laws allow counties
to foreclose on and sell properties for not paying their
taxes, but the process requires
lengthy research and notification which adds to its expense.
However, Anderson County
Commissioners in recent years
have been more aggressive in
pursuing those periodic sales,
with the idea of selling the
delinquent properties to new
owners, even at a loss, to hopefully get them back on the paying tax rolls.

June 30-July 4 in Anaheim,
California. More than 8,700
participants from across the
country gathered together to
attend leadership and program trainings, hear national
speakers, meet youth leaders
from across the nation, participate in Competitive Events,
and explore college and career
options.
Over 4,700 FCCLA members competed in STAR
(Students Taking Action with
Recognition) Events at NLC.
STAR Events are competitive
events in which members are
recognized for their proficiency and achievement in chapter and individual projects,
leadership skills, and career
preparation. Both youth and
adults work together in managing the events and serving as
evaluators of the participants.
Students develop real world
skills participating in STAR
Events.
Events aim to support student development of knowledge and skills by enhancing
the classroom experience and
career pathway initiatives
by equipping students with
employable skills and industry
insights needed to thrive in the
21st century. FCCLA members
choose what STAR Event they
would like to compete in, events
vary from Early Childhood
Education, Entrepreneurship,
and Sports Nutrition to Fashion
Design, Job Interview, and
Culinary Arts.

Wolken Tire has been up and running with business as
usual, but with very heavy hearts. At this time, we wish
to extend a huge thank you to our community for all of
the love and support during Jacks illness and death.
Our customers patience and understanding during
this difficult time is so greatly appreciated.
Asher Velvick accepted the position as shop manager in
December 2018 and continues to meet our customers
needs. Daniel Holstine continues to provide numerous
specialty services such as alignments, brake repair and
many other types of suspension service. Jacob Rundle
continues all tire services, oil changes and assisting in all
departments, as he continues to learn all aspects of the tire
business. Mason Skiles graciously jumped on board as a
tire technician this summer and he will be greatly missed
when he goes back to college this month!

a new nursing scholarship
Beginning with the Fall
semester of 2019, a $2,000 per
semester scholarship will be
available for Anderson County
High School graduates who are
enrolled in an associate degree,
bachelor of science degree or
graduate degree in a profes-
sional nursing program.
Emphasis in awarding the
scholarship will be placed on
financial need and the personal commitment the applicant
has toward the caretaking
involved in professional nursing.

A free Yoga workship will
take place at the Garnett
Recreation Center on Saturday
August 10, 2019 from 10 a.m. noon.
The instructors will be
Jenelle Klehammer and Karen
Mueller. They will emphasize
the benefits of Yoga.
Currently there are two different Yoga sessions available
for the public at $4.00 per class.
The
morning
classes,
instructed by Klehammer,
are Monday, Wednesday and
Friday from 8:45 – 9:45.
The
evening
classes,
instructed by Mueller, are
Tuesday, Wednesday and
Thursday from 5:30 – 6:30.
The Wednesday class is
geared toward the more prac-
ticed individuals.
Persons of all ages and fitness levels are invited to give it
a try and see if they like it. The
instructors will be sensitive to
the needs and abilities of anyone who wants to give Yoga a
chance.

Kellermans host family reunion
The 66th annual Kellerman
family reunion was held
July 14, 2019 at Kelley Park
in Burlington Kansas hosted
by Allan Kellerman son of the
late Charles (Bill) and Ginny
Kellerman.
The late Ed and Belle
Kellerman were parents of 14
children. Eight are still living.
This year, three of the eight
children were present with several of their children, grandchildren, great grandchildren
and great-great grandchildren.
Sister Ina Belle Railsback
was unable to attend due to
health reasons. There were 66
in attendance this year.
After the fun and visiting,
pictures were taken of the
families. Next years family
reunion will be hosted by the
Eileen Canfield family. Next
years reunion will be July 12,
2020.

our Brother, Charles (Bill)
Kellerman and Hazel Hoefler,
wife of Vincent Hoefler, Jr.
The family decided to take
up a collection and donate
to the Westphalia Veterans
Memorial wall that is being
built in the park at Westphalia.
They collected enough to
send $100.00. Since most of
the Kellerman boys served in
the military and most of the
Kellerman girls husbands
served, everyone thought it
was a good idea to help by giving this gift.
MFA announces annual meeting
The 2019 annual meeting of
the Garnett MFA Oil Company
bulk plant has been scheduled
for 11 a.m. – 1 p.m. on August
8, 2019 at 704 N. Maple St. in
Garnett, according to David
Shriver, Territory Manager.
Activities at the meeting
will include a business report
for the 2018 fiscal year, election of delegates for the year
to come and drawing for door
prizes.
All families are welcome,
whether or not they are members of the MFA Oil Company.
